Ethical Considerations for Representing Elderly Individuals With Diminished Capacity

How sharp does an elder have to be to sign a legal document such as a Will, Financial Power of Attorney, or Contract?

Elder Law Attorney Dennison Keller will explain the definitions and standards of legal capacity and how they vary depending on what documents a client is signing. Elder Care Coordinator/Social Worker Merne Pratt will also talk through the best practices and strategies she uses to determine an elder’s competence based on the document, the diagnosis of the elder, the location of the signing, and even whether or not the elder is having a “good day.”

They will also discuss practical steps for advocating for an elder, even in the face of a difficult diagnosis that affects cognitive abilities.
