Top 10 Mistakes Made on the Elder Care Continuum

We have the best intentions as we try to make an effective plan as we age, but there are so many pieces to consider when actually executing a plan that protects assets and a person’s quality of life. Many mistakes are made along the way. Our attorney will focus on the most common missteps and how to avoid them.
This is our most requested community presentation.

Essentials of Elder Law

This class provides attendees with a better understanding of the basics of elder law, including the traditional role of an Elder Law Attorney, the Elder Care Continuum, the purpose of a will, what a living will does, and when a trust may be useful. We will also look at how a financial power of attorney and a healthcare power of attorney work, the two types of Guardianships, and the Life Care Planning model.

What is Life Care Planning?

Our law firm operates under the Life Care Planning model; we move beyond a transactional approach to provide a holistic solution to one’s legal and care needs. This course provides an understanding of what exactly Life Care Planning is, how it plays into a person’s quality of life and care, and how the elder care puzzle pieces fit together. It also explains the documents to have in place and the difference between a variety of legal options.

Medicaid: You Don’t Know What You Don’t Know

Medicaid is a complex topic that involves many questions. Our attorney will give professionals a clear and working knowledge of Medicaid, covering key powers to be included in the financial power of attorney, asset eligibility, and the allowable exemption options for single individuals and couples. We will also cover the Medicaid spend-down and the five- year lookback.

Financial Powers of Attorney – The Power is in the Documentation

A financial power of attorney document can be a powerful tool in estate planning. This session gives an overview of the importance of estate planning, the standard powers in an FPOA, what to look for in an FPOA, and how an FPOA is used in a crisis.

Advanced Directives: Health Care Power of Attorney, Living Will, and DNR

This course will give attendees an enhanced understanding of the impact of an individual’s health care power of attorney and living will in various life scenarios. Every situation has its own variables, often requiring professionals to reevaluate responses and support. These documents are essential in individualized care.

Guardianships: How to Obtain Them and Why You Should Avoid Them

This course will include an overview of two types of Guardianships and their advantages and disadvantages. Participants will learn who can be a Guardian and the residential requirements of a Guardianship. The class will also include clarification on who the Ward is in a Guardianship case and when a Conservatorship is an appropriate option to consider.

Trusts: What Are They and What to Do With Them

This course provides an understanding of the importance of estate planning, when trusts are appropriate, including revocable and irrevocable trusts, testamentary capacity, and how intestate succession works. Attendees will leave with a better working knowledge of trusts and when they could be helpful to their clients and their families.
